Terms of Service

1. Acceptance of Terms

By engaging PixelEruption for any digital service — including web development, SEO, social media management, animated banners, email marketing, CMS development, graphic design, or project management — you agree to be bound by these Terms of Service. If you do not agree, please do not proceed with the engagement.

2. Services

PixelEruption provides enterprise digital services as described in the proposal or statement of work agreed upon with each client. The specific scope, deliverables, timeline, and pricing are defined in the individual project proposal. PixelEruption reserves the right to decline any project at its discretion.

3. Proposals and Quotes

All proposals and quotes are valid for 30 days from the date of issue unless otherwise stated. Acceptance of a proposal constitutes agreement to these Terms of Service. Changes to scope after acceptance may result in revised pricing and timeline.

4. Payment Terms

Payment terms are specified in the project proposal. Unless otherwise agreed, projects require a deposit before work begins, with the balance due upon completion or at agreed milestones. Late payments may incur interest charges of 1.5% per month. PixelEruption reserves the right to suspend work on any project with outstanding balances.

5. Intellectual Property

Upon receipt of full payment, the client receives ownership of the final deliverables created specifically for their project. PixelEruption retains ownership of all tools, frameworks, methodologies, and pre-existing intellectual property used in delivering the services. Third-party assets (stock photography, fonts, plugins, licensed software) remain subject to their respective licenses.

6. Client Responsibilities

Clients are responsible for providing accurate information, content, and materials required for project completion in a timely manner. Delays caused by late delivery of client materials may affect project timelines and are not the responsibility of PixelEruption. The client warrants that all materials provided do not infringe any third-party intellectual property rights.

7. Confidentiality

Both parties agree to keep confidential any proprietary information shared during the engagement. PixelEruption will not disclose client business information, strategies, or data to third parties without written consent, except as required by law. This obligation survives the termination of the engagement.

8. Revisions and Approvals

The number of revision rounds included in each project is specified in the proposal. Additional revisions beyond the agreed scope will be billed at our standard hourly rate. Client approvals at project milestones are required to proceed. Silence for more than 14 business days after a milestone submission will be treated as approval.

9. Limitation of Liability

PixelEruption's total liability for any claim arising from a project shall not exceed the total fees paid by the client for that project. PixelEruption shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, loss of data, or business interruption, even if advised of the possibility of such damages.

10. Termination

Either party may terminate the engagement with 30 days' written notice. Upon termination, the client shall pay for all work completed to date. Work product completed up to the termination date will be delivered upon receipt of payment for those services.

11. Governing Law

These Terms of Service are governed by the laws of Costa Rica. Any disputes arising from these terms or from the services provided shall be subject to the exclusive jurisdiction of the courts of San José, Costa Rica.
